1. Introduction
These Terms of Service (“Terms”) govern your use of BullishFx’s services, including its online trading platform, mobile application (“BFx Mobile” or “MT4”), and related services (collectively, the “Services”). By using the Services, you agree to these Terms. BullishFx is a trademark of Oval Capital International Ltd., Hong Kong. Oval Ltd., Seychelles, is the liquidity and quotation provider.
2. Risk Disclosure
Trading leveraged products like Contracts for Difference (CFDs) and Forex on the over-the-counter (OTC) market is highly risky and may lead to substantial losses, exceeding your initial deposit. Leverage magnifies both profits and losses. You are responsible for understanding the risks involved, considering your financial objectives and experience, and seeking independent advice if needed. BullishFx is not liable for your trading losses.
3. Account Registration and Security
You must register an account (“Account”) with accurate information. You are responsible for the security of your Account credentials (email, mobile number, password) and must prevent unauthorized access. These credentials are used for essential communications, including One-Time Passwords (OTPs) for login and transaction authorization.
4. Electronic Communications and Transactions
You agree to electronic communication and transaction execution. All agreements, notices, and disclosures will be provided electronically. You confirm having the necessary hardware and software to access and retain these electronic records.
5. Trading Rules and Conduct
You must adhere to all applicable laws and regulations. Engaging in fraudulent, manipulative, or illegal activities is prohibited. You are solely responsible for your trading decisions. You must not allow others, including BullishFx marketers or affiliates, to operate your Account. You are prohibited from exploiting system vulnerabilities or collaborating with BullishFx personnel for unfair advantage. Such actions may lead to transaction cancellation and account termination.
6. Fees and Charges
You agree to pay all applicable fees, including commissions, spreads, rollovers, overnight fees, deposit/withdrawal fees, and other charges as disclosed by BullishFx. These fees will impact your net profit/loss.
7. Deposits, Withdrawals, and Conciliators
Deposits and withdrawals are made through designated channels. You bear the risk of currency exchange fluctuations. For certain jurisdictions, BullishFx uses third-party payment processors (“Conciliators”). While BullishFx works with Conciliators, it does not guarantee their service quality and is not liable for issues arising from their performance. You may opt out of using a Conciliator and transact directly with BullishFx, subject to its policies.
8. Trading Facilities and System Disruptions
OTC trading occurs outside regulated exchanges and does not require open outcry. Quotes may vary due to market liquidity. Electronic trading systems are susceptible to disruptions. BullishFx is not responsible for losses due to system failures, connection issues, or market conditions. Your recovery of losses may be limited by the liability limits of system providers and financial institutions.
9. Quotation Errors
In case of quotation errors, BullishFx will conduct arbitration, and its decision will be final and binding. BullishFx reserves the right to correct or adjust accounts affected by such errors and may halt trading on certain currency pairs under specific circumstances.
10. Disclaimer of Warranties and Limitation of Liability
BullishFx provides the Services “as is” and disclaims all warranties, express or implied. BullishFx is not liable for data inaccuracies, system delays, or losses arising from factors beyond its control, including hardware/software failures, internet issues, market conditions, or force majeure events. BullishFx reserves the right to modify or discontinue any feature or the entire Service without prior notice.
11. Indemnification
You agree to indemnify and hold harmless Oval Ltd. Seychelles, its affiliates, shareholders, directors, and employees from any claims, losses, or costs arising from your use of the Services.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Hong Kong. Any disputes will be resolved under Hong Kong jurisdiction.
13. Restricted Jurisdictions
BullishFx does not offer services to residents of certain jurisdictions, including the USA, Iran, North Korea, Europe, the United Kingdom, and others.
14. Entire Agreement
These Terms constitute the entire agreement between you and BullishFx and supersede all prior communications. By using the Services, you confirm understanding and acceptance of these Terms and the associated risks. You acknowledge having the ability to access and comprehend these Terms.
